Agreement and eligibility
These Terms of Service ("Terms") govern access to HeavyFeather ("HeavyFeather," "we," "us," or "our") at heavyfeather.ai. By requesting an account, creating an approved account, or using the service, you agree to these Terms and the Privacy Policy. If you use HeavyFeather for a business or organization, you represent that you are authorized to bind it.
You must be at least 18 years old and legally able to enter into this agreement. Do not use the service if applicable law prohibits you from doing so.
The service
HeavyFeather is an actively developed commerce workspace. Its HeavyFeather Operator experience can research, calculate, organize evidence, make recommendations, prepare drafts, connect third-party services, and record approvals and outcomes. Features may be experimental, incomplete, changed, suspended, or removed as the product develops.
HeavyFeather does not guarantee sales, revenue, margin, advertising performance, supplier performance, legal compliance, or business success. Forecasts, scores, and recommendations are estimates and decision support, not verified outcomes or professional legal, tax, accounting, investment, or financial advice.
Accounts and security
You are responsible for accurate account information, maintaining the confidentiality of your credentials, and activity performed through your account. Notify us promptly if you believe your account or a connected credential has been compromised.
HeavyFeather is currently offered through manual early-access approval. Submitting a signup request does not guarantee access. A new account remains pending and cannot sign in until HeavyFeather staff approves it. We may approve, decline, defer, limit, or revoke early access in order to operate and protect the developing service.
You may authorize only accounts, stores, advertising properties, supplier relationships, content, and data that you own or have permission to manage. You remain responsible for the people you authorize to use your workspace.
Human approval and business decisions
HeavyFeather Operator may prepare work and recommend actions, but you are responsible for reviewing decisions and confirming consequential actions. The current product is designed so that spending money and publishing externally require human authorization. You remain responsible for prices, claims, listings, campaigns, inventory, taxes, regulatory obligations, and customer commitments.
Do not rely on an automation, integration status, recommendation, or generated draft without reviewing the underlying facts and the action that will occur.
Connected services
HeavyFeather may connect to independent services such as Google Ads, Shopify, Cloudflare, or supplier platforms. Your use of each provider is also governed by that provider's terms and policies. Providers may change APIs, data, pricing, permissions, or availability at any time.
We are not responsible for a third party's products, fulfillment, outages, account decisions, content, data accuracy, or conduct. You authorize HeavyFeather to communicate with a connected provider only within the permissions and features you approve.
Acceptable use
- Do not violate law, intellectual-property rights, privacy rights, advertising rules, marketplace policies, or provider terms.
- Do not sell prohibited or unsafe products, make deceptive claims, impersonate others, send spam, or facilitate fraud or abuse.
- Do not probe, disrupt, reverse engineer, overload, bypass access controls, introduce malicious code, or attempt to obtain another user's data.
- Do not use HeavyFeather or connected-provider data to build surveillance systems, determine creditworthiness, resell provider data, or train generalized models in violation of provider policy.
Your content and feedback
You retain ownership of content and business information you submit. You grant us a limited, worldwide license to host, process, reproduce, and transmit that content only as needed to provide, secure, and improve the service and the user-facing features you request.
You represent that you have the rights needed to provide the content. If you voluntarily provide product feedback, you permit us to use it without restriction or payment, but we will not identify you publicly without permission.
Fees
HeavyFeather does not currently charge through this application. If paid plans are introduced, the price, billing interval, taxes, renewal terms, and cancellation process will be shown before you authorize a charge. Third-party providers may charge their own fees, and you are responsible for charges you separately authorize with them.
Suspension and termination
You may stop using HeavyFeather at any time and may request account deletion. We may limit, suspend, or terminate access when reasonably necessary to protect users or the service, address security or legal risk, prevent abuse, respond to provider requirements, or enforce these Terms. Where practicable, we will provide notice and an opportunity to resolve the issue.
Disclaimers and limitation of liability
To the maximum extent permitted by law, HeavyFeather is provided "as is" and "as available" without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or error-free operation.
To the maximum extent permitted by law, HeavyFeather and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, data, goodwill, or business opportunities; or third-party charges or actions arising from the service. Nothing in these Terms excludes liability that cannot legally be excluded.
Changes and contact
We may update these Terms as the service develops. We will post the updated version, revise the effective date, and provide additional notice when required. Continued use after an update takes effect constitutes acceptance to the extent permitted by law.
